Randomized controlled trials test new drugs using various debiasing devices to prevent participants from manipulating the trials. But participants often dislike controls, arguing that they impose a paternalist constraint on their legitimate preferences. The 21st Century Cures Act, passed by US Congress in 2016, encourages the Food and Drug Administration to use alternative testing methods, incorporating participants’ preferences, for regulatory purposes. We discuss, from a historical perspective, the trade-off between trial impartiality and participants’ freedom. We argue that the only way (...) out is considering which methods improve upon the performance of conventional trials in keeping dangerous or inefficacious compounds out of pharmaceutical markets. The debate about the meaning of color terms in the philosophy of language has been dominated by two main issues. Firstly, there is the discussion about the context-dependency of color terms, specifically, quantity, the degree to which the object is of the color, and one of the dimensions of color quality, hue. Secondly, there is the question of how indexical contextualism can account for these elements of context-dependence. The aim of this chapter is twofold. First, to examine brightness, one of (...) the dimensions of color quality that has been neglected in the literature. For this purpose, we will examine how the equivalent of “white” in Arabic and Spanish interacts with brightness modifiers. The analysis will allow us to distinguish three different usage patterns, light source, light reflection, and contrast between white and black, pointing to three new ways of contextual incompleteness of color terms. Second, to assess indexical theories of color terms considering these new empirical findings. We will argue that the results of our study offer support for indexical contextualist theories by distinguishing new dimensions of contextual incompleteness of color terms. However, the consequences of applying the standard indexical contextualist explanation–hidden-variable analysis– are too strong. (shrink)

Physical activity, body composition and sedentary behavior may affect the health of children. Therefore, this study examined the effect of an educational hybrid physical education program on physical fitness, body composition and sedentary and PA times in adolescents. A 9-month group-randomized controlled trial was conducted in 150 participants allocated into the control group and experimental group. Cardiorespiratory fitness, speed, strength, agility, flexibility and body mass index were assessed through previously validated field tests. Sedentary time, PA at school and afterschool were (...) evaluated with the Youth Activity Profile-Spain questionnaire. Significant differences were observed concerning to the CG in APA-weekend, speed-agility and agility. Regarding the intervention, cardiorespiratory fitness, speed-agility, strength, flexibility, agility, PA in school, APA-weekday, APA-weekend, APA-week, and sedentary time increased significantly in the EG. The use of a hybrid program based on teaching personal and social responsibility and gamification strategies produced enhancements in cardiorespiratory fitness, agility, speed, APA-weekdays and APA-weekends, reducing the sedentary time. Frente a las posiciones relativistas que consideran que no existe la posibilidad de trascender la perspectiva de una mirada necesariamente anclada en una u otra cultura y su equipaje conceptual, sostenemos que siendo innegablemente cierto que la ciencia es también un producto cultural, es sin embargo mucho más y se erige como un saber de tipo transcultural, es decir, que trasciende los elementos locales (...) de toda cultura y posee privilegios epistémicos que la posicionan por encima de cualquier otro tipo de conocimiento. Some authors sustain that historical research is an effect of a specific historiographical context (Jenkins, 1991; González de Oleaga, 2009). An approach to the historiographical debate between constructivism and recontructivism is presented in this paper. Two theses are here defended. The first one affirms that the above mentioned debate is deeply related to epistemological questions (study of mental representations, different conceptions about historical reasoning functions, historical reasoning, cognitive bias, and informal falacies). The second thesis affirms that each historiographical conception can (...) be understood as the effect of assuming a specific perspective about these epistemic questions. As an evidence of this, some connections between historiography and epistemology will be analysed through the analogy between the reconstructivism vs. constructivism debate, and the epistemological debate detectivism vs. constitutivism (Finkelstein, 2003). Americans' appetite for life-prolonging therapies has led to unsustainable growth in health care costs. It is tempting to target older people for health care rationing based on their disproportionate use of health care resources and lifespan already lived, but aged-based rationing is unacceptable to many. Systems reforms can improve the efficiency of health care and may lessen pressure to ration services, but difficult choices still must be made to limit expensive, marginally beneficial interventions. In the absence of agreement on principles (...) to govern health care resource allocation, a fair, open priority-setting process should be created to allow for reasonable disagreement on principles while being seen as legitimate by all stakeholders. At the patient-care level, careful discussions about the benefits and burdens of medical intervention and support for slow medicine — a gentle, family-centered care approach for frail elders — can do much to avoid harming these patients with aggressive yet unwanted medical care while reducing wasteful spending. This question is often on my mind, not least because for the (...) last seven years ofmy tenure at Stanford I studied ethnic conflict and filled my mind with the most discouraging images. I found myselfsaying on occasion that I felt ashamed to be a human being, which was only a slight exaggeration. I noted with wry amusement that a few years ago it was reported that the wolves were fleeing from the Caucasus in great numbers because ofthe human violence there, a sad irony in the light of Thomas Hobbes' motto, Homo homini lupus. I had long suspected thatthat was an insult to wolves, and now I had the proof. Lately we have Philip Gourewitch's new book on the Rwanda holocaust of 1994, where they killed one million people in ten weeks, not with weapons ofmass destruction butwith machetes and clubs primedwith six-inch nails, and Rwanda is a Christian country. The voice ofconscience cries out, "Where is our God?" in all this; why does He spend his time causing statues to ooze oil in suburban Massachusetts rather than defending the children of Kosovo against depraved nationalists.1 It is some comfort that the psalmist cried the same question and thus provides a convenient way into a meditation on violence in the Psalms. It occurs first in 42,3: "I have no food but tears / day and 1I refer to the phenomena reported in connection with the comatose teenage girl, Audrey Sosa, who is believed by some to be a channel for miracles. 152Robert Hamerton-Kelly night:/ and all day long men say to me,/ Where is now your God?" and again at 42,10, "Nearly breaking my bones / my oppressors insult me / as all day long they ask me / Where is now your God?" In 79, 10 it occurs in a national lament, "Why should the pagans ask, Where is their God?" and this recalls two prophetic oracles, in Joel 2,9, "Spare yourpeople Yahweh!/ Do not make your heritage a thing of shame, a byword for the nations./ Why should it be said amongthe nations,/ Where is their God?" and Micah 7,10 "When my enemy sees it (my vindication)/ she will be covered with shame,? she who said to me: Where is Yahweh your God?" So there are two classes of such sayings, one by an individual and one by the nation. Much ink has been spilled on the questions, Who is the victim?, and Who are the enemies? The answers have canvassed all the possibilities from the lone individual beset by spiritual temptations, or David himselfin his days and nights as a fugitive, to the nation beset by rival nations.2 The victim surrounded by persecutors is clearly a major category in the Psalms, present in two thirds ofthe collection; one hundred out ofthe one hundred and fifty explicitly or implicitly refer to a victim surrounded by enemies.3 Let me cut to the chase and recall that according to René Girard's mimetic theory, which I take as a point of departure, the situation of the victim surrounded by a mob ofenemies is a structural not an historical situation.4 The deep structure ofhuman history is a victim surrounded by the mob, a lamb slain since the foundation ofthe world. This deep structure controls the shape of emergent history but that emergence conceals its deep structure by turning history into myth. Myth covers up the blood stains and stifles the voice of the victim, myth accuses the victim, presents the victim as guilty or willing and the persecutors as innocent. To this day much that claims to be history is really myth. History happens only when the voice ofthe victim comes to word, and for that reason the gospel is irreducibly history and not myth. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

According to robust versions of virtue epistemology, the reason why knowledge is incompatible with certain kinds of luck is that justified true beliefs must be achieved by the agent . In a recent set of papers, Pritchard has challenged these sorts of views, advancing different arguments against them. I confront one of them here, which is constructed upon scenarios affected by environmental luck, such as the fake barn cases. My objection to Pritchard differs from those offered until now by Carter (...) , Jarvis or Littlejohn in that it is based on the claim that cognitive performances may not be properly considered as achievements beyond the scope of the agent’s intentional action—an idea that confers more explanatory power on my argument, and contributes to stregthening links between knowledge and agency. I.e., instead of the traditional anti-luck diagnosis of Gettier cases and fake barn cases, a new anti-risk diagnosis seems to be preferable by many. My goal in this paper is twofold: first, I contribute to motivate that drift; and second, I defend that we ought to partially resist it. An anti-risk diagnosis is valid and preferable for fake barn cases, but we still (...) need an anti-luck diagnosis for classic Gettier cases. The paper thus defends the Solomon-like result that we need both concepts—epistemic luck and epistemic risk—to deal with all the cases where knowledge is undermined. (shrink)

This paper advances new theses about the relationship between luck and risk, using recent work by Duncan Pritchard (2014, 2015, 2016) as its foil. Once Pritchard’s views are introduced in section 1, the rest of the paper completes two different tasks, one critical and one constructive. By focussing on some epistemological cases that Pritchard’s model would fail to identify, section 2 shows that it relies on a difference that is in fact inessential: the one between the occurrence and the non‐occurrence (...) of an event. Section 3 sketches and defends an alternative account of the luck/risk distinction, based on the consideration of situations (instead of events) from different temporal perspectives: luck assessments track a situation’s past, considering it the actual outcome of some previous event, whereas risk assessments look at the situation’s future, regarding it as the initial condition of some unsettled event. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). RESUMENEste artículo propone una aproximación a la ética de la alteridad de Emmanuel Lévinas tomando como eje argumentativo la noción «rostro». En primer lugar, este concepto nos permitirá profundizar en la articulación de la relación de alteridad bajo un enfoque pragmático-lingüístico. Posteriormente, nuestra reflexión se abrirá a un análisis del mismo, en tanto que palabra y discurso, que derivará en un estudio de la responsabilidad levinasiana. It is generally accepted that, around the turn of the century, GIBBS and EINSTEIN independently developed two equivalent formulations of statistical mechanics. GIBBS version is taken as genuine and rigorous, while EINSTEINs, despite some features which are characteristic of him, is usually considered a not totally satisfactory attempt.It will be shown in the present work that such a picture is oversimplified and requires further nuancing. In fact, there are significant differences, with important implications which have not been sufficiently examined, between (...) the two formulations. We explore success drivers of reward-based crowdfunding for poverty alleviation in China. The results from our econometric modeling using data from 4375 reward-based crowdfunding campaigns suggest that poverty alleviation campaigns, as compared to ordinary ones, benefit from higher funded amounts, larger backer numbers, and greater success rates. The results also suggest that poverty alleviation campaigns perform better when the products sold originate from poorer (as compared to wealthier) regions and when price premiums are lower (as compared to higher). We corroborate (...) important findings from the field study with an experimental study, showing that the consumer’s feeling of warm glow accounts for the positive effects of poverty alleviation campaigns (as compared to ordinary) campaigns. We expand the applications of warm-glow theory into the context of reward-based crowdfunding campaigns for poverty alleviation and offer new insights into success drivers of such campaigns. (shrink)

Historical accounts of the work of J. J. Thomson find a contradiction in his work. On the one hand, he is presented as a Maxwellian theoretical physicist dealing with a typically Victorian entity, the ether. On the other hand, the analysis of his experimental work at the Cavendish seems to have little connection with his mathematical work. In this paper, I discuss the metaphysical views of J. J. Thomson, and argue that his deep belief in the ultimate continuity of matter (...) can be seen to give a framework to both his theoretical and his experimental work. His metaphysical beliefs were not in the least shaken by the discovery of discrete phenomena and entities, not even by his suggestion of the existence of corpuscles later known as electrons. His formation in Cambridge, together with some ideas that he acquired in his youth at Owens College, Manchester, are the key to understanding his metaphysics and the role it plays in his scientific work. El presente trabajo recoge un análisis comparativo realizado entre diversos códigos y recomendaciones de buen gobierno tanto a nivel nacional como internacional. Durante el estudio, se ha revisado una amplia muestra de códigos de gobierno corporativo, prestando especial atención a los aspectos incluidos en los mismos relativos a la composición de los consejos de administración, la voluntariedad versus obligatoriedad de las recomendaciones, el tratamiento otorgado a las figuras de Presidente y CEO, etc., identificando las principales diferencias y similitudes entre ellos (...) y mostrando la evolución temporal de las distintas recomendaciones en los diferentes países e instituciones analizadas. Tras el análisis comparativo se observa que la mayoría de los códigos se orientan en la misma dirección, incluyendo apartados similares en todos ellos, aunque también existen pequeñas matizaciones específicas que los diferencian. La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. Nowadays philosophy is characterized by such heterogeneous intellectual practices that its very unity and coherence seem endangered. What is especially disconcerting is that most authors manage to largely ignore the very existence of methodological positions radically different from their own. Fortunately, there have been exceptions, and the present volume focuses on one of them: the failed debate that took place between John Searle and Jacques Derrida. -/- This book thoroughly analyses that exchange, contextualizing it within the respective philosophical traditions of (...) the two thinkers, with the general aim of turning their dispute into what it was not: a respectful, sensible and fruitful controversy. This episode is thus taken as an opportunity to reflect on the peculiar nature of philosophy as an intellectual practice, and to discuss some of its main themes: language as an instrument for communication, the intentionality of consciousness, and difference as a constitutive element of every text. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación.
